Domestic Case Preparation
It is very important to get any and all witnesses you can for your case. While it is important to get good quality witnesses to come to testify for you about relevant matters, it is good to have a number of witnesses to testify for you for a number of reasons. Even if they are going to testify about things that the other side may admit to or are quite obvious. GRANDPARENTS Are good witnesses for a number of reasons.
TEACHERS Teachers have a lot of credibility because of their position as educators. They are often honored to testify on your behalf if you let them know you need their help. They can testify to a number of factors such as you being a good parent and your child being smart, a good student and you taking the time to make sure your child does well in school. CHURCH The use of church personal such as pastors and Sunday school teachers is very powerful. Judges fear the power of the church, because churches members. God is good and they don’t want to be against God. FRIENDS Friends help because they show you are a good person and people like you. They also can be a useful tool to intimidate your spouse and keep your spouse honest. FAMILY Family can be useful to show support and can keep your spouse honest. They may also know facts that can be very useful to you. SCHOOL RECORDS School records can show that you are an interested parent, that your child is doing well, and that you care about your child. If your spouse has done a poor job this is an excellent way to show it. MEDICAL RECORDS Prove that you take care of your child and care about your child. CRIMINAL RECORDS Can be used to show that your spouse is violent, has behavioral problems, or does not respect authority. Note: drug crimes, domestic violence, and DUI crimes are very powerful. NEIGHBORS Neighbors may know stuff that can help you. I have had them help me, and hurt you. INTEROGATORIES You can send questions to your spouse to have them answer under oath. These are a very useful discovery tool. DEPOSITIONS You can asks them questions in person, and use them in trial. ASSETS/DEBTS You can get information on assets and debts that can be used to help you in the trial to show that your spouse has a lot of assets or that you have a lot of debts. REAL ESTATE INFO Often time the most valuable assets is the house knowing the true value of this asset is a very valuable tool. IRA/401-K INFO The court has the ability to order a decision of retirement benefits. This can be a very useful tool. PROBATE RECORDS A search of the probate court records is a good way to find what assets a leins they own or have. DEPARTMENT OF HUMAN RESOURCES Is or was DHR involved in the case. If so this is a very important matter. They have a lot of influence with the Court and their power goes beyond that of the Court. DRUG TEST If a party is doing drugs you can request a drug test. Two types of test are generally given.
OTHER Use your knowledge of the situation to help prepare your case to get the best possible resolution of your case. DISCOVERY Asssets What types of properties do they own. This is a very big area it is very important to have a very good understanding and knowledge of what type of properties that the other party either owns or has a right to in the future. Examples include real estate, mobile homes, rental properties, condos, time shares, stocks bonds , mutual funds, retirement plans, iras , 401-ks, teachers retirement plans, state retirement plans, cash, notes that they are entitled to receive, autos, trucks, tools, furniture, ect. Relationships with romantic partners Relationships with children Prior criminal records Educational records Driving records Credit card records show where they spent their money Mental health issues
